Attempt to remove judges violation of Article 6: SC

ISLAMABAD: The Supreme Court in its short order in the case regarding withdrawal of judges' restoration notification reports stated that the government has failed to satisfy the Court and any attempt to remove the judges would be tantamount to treason, Geo News reported Friday. The court said that the executive order of 16th March 2009, restoring the sacked judges has lost its effectiveness after the 31st July 2009, verdict and heads of all constitutional organs must abide by the judgement. The order also restrained all the heads of constitutional organs of the country including the president from restoring it. The court also noted that the media reports were not false and asked the government to probe into the matter and submit the report on October 18, 2010. Later, the hearing was adjourned till October 18 with the instruction that a clear-cut policy statement must be submitted on the day. Earlier, the government sought more time to reply to the Supreme Court's explanation regarding government's policy regarding notification of restoration of judges.

ISLAMABAD: Prime Minister Syed Yusuf Raza Gilani attended a reception hosted by Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhry in honour of Justice ® Khalil-ur-Rehman Ramday here at the Supreme Court building on Tuesday night.The Prime Minister, upon arrival at the Supreme Court, was warmly received and welcomed by Chief Justice Iftikhar Muhammad Chaudhry.Prime Minister Gilani shook hands with the judges, lawyers and other participants. The Chief Justice of Federal Shariat Court, the Chief Election Commissioner and a large number of Supreme Court lawyers including President Supreme Court Bar Association (SCBA), Qazi Anwar and former President SCBA Aitzaz Ahsan were also present on the occasion. The participants were surprised to see the Prime Minister amongst them, as nobody knew about his arrival at the function. Later in a brief chat with newsmen, the Prime Minister said, “it is our own country and we have to work unitedly.

 

CJP calls for discouraging redtap culture

PESHAWAR: Chief Justice of Pakistan, Justice Iftikhar Muhammad Chaudhry on Wednesday stressed the need for discourage redtap culture especially in pension cases and stressed the need for strict decisions for provision of quick and inexpensive justice to litigants. The Chief Justice passed these remarks while hearing a case regarding the unpaid pension of late government employee Fareedullah here at SC Registry. The division bench consisting of Chief Justice Supreme Court, Justice Iftikhar Muhammad Chaudhry and Justice Chaudhry Ijaz Ahmed upheld the decision of Peshawar High Court regarding payment of late Fareedullah’s pension to his family. In his remarks, the CJP said redtape culture would not be allowed in pension cases and strict decisions have to be taken with an objective for provision of speedy justice to litigants. The CJP said the courts would not flinch back from providing speedy justice to all. Peshawar High Court (PHC) has issued the orders regarding the payment of Fareedullah’s pension, who passed away in 2000; however, his family has not received his pension as yet. Later on, the concerning department of Textbook Board filed an appeal in the apex court against payment of pension to the late government employee. However, the bench consisting of CJ Chaudhry and Justice Chaudhry Ejaz Ahmed upheld the PHC verdict.

 

Sugar retail price to stay Rs 40 per kilogram till final decision: CJP

ISLAMABAD: Supreme Court (SC) has ordered, that sugar will be sold out at the retail price of Rs 40 per kilogram till final decision is pronounced. . A 3-member bench of SC headed by the Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry and comprising justice Ghulam Rabbani and justice Jawad S Khawaja resumed the hearing of the case Thursday. Farooq Amjid Mir advocate while giving the arguments on behalf of SDA took the plea sugar dealers had purchased sugar at the rate of Rs 40 per kilogram from the owners of sugar mills adding it was impossible to sell out the sugar at this or less than this price. CJP inquired Farooq Mir if SDA was a registered body. Farooq Mir told it was not registered body. However we make deals with sugar mills owners in our personal capacity and sell out it to the retailers. CJP asked him to present the documents in the court about the rate at which sugar purchase agreements were made by him with the mill owners.
